What happens if I attack an absent player who I share "right of way" with?

My Ally is now long gone, I share right away with him. I was thinking of placing my units in his territory, then attacking at one spot somewhere? Will my units place in his uncontested territory simply take it over?

Yes, that is the way it works.

Always good to plan out your moves. The AI will maneuver units once you declare war, so don't leave yourself open to invasion.
